1. CALL TO ORDER, ROLL CALL, DETERMINATION OF QUORUM

President Shaikewitz called the meeting to order at 6:34 p.m.

There were no members of the public present who wished to speak on items not on the agenda.

3. Public Meeting: Rates, Service Charges and Fees

A) Public Meeting to Receive Public Comment on the Proposed Conservation Rates, and Changes to Service Charges and Meter Fees

President Shaikewitz gave an overview of the water situation in Montecito Water District and requested Mr. Mosby to give the staff report on the proposed Ordinance and Resolution including minor changes and clarifications in response to comments from the August 19 meeting. Following the staff report, the President opened the meeting for public comment. The following members of the public addressed the Board:

1) PROPOSED ORDINANCE 90 ESTABLISHING DEFINITIONS AND CLASSIFICATIONS AND AMENDING DISTRICT ORDINANCE 82
When all members of the public who wished to address the Board had spoken, President Shaikewitz closed the public comment portion of the agenda. The Board discussed Ordinance No. 90 and accepted certain revisions as suggested by staff, including expansion of the proposed definition of the Agricultural classification to include floriculture in addition to crops grown for human consumption. Following discussion it was moved by Director Morgan, seconded by Director Wilson, and carried by the following roll call vote to adopt Ordinance No. 90 as revised, effective October 1, 2008:

AYES: Directors Abel, Frye, Morgan, Shaikewitz, and Wilson

NOES: None

ABSENT: None

ABSTAIN: None

2) PROPOSED RESOLUTION No. 2047, ADOPTING WATER RATES AND SERVICE CHARGES

It was the consensus of the Board to increase the Single-family Residential block one to 0-25 units, the Multi-Family Residential block one to 0-9 units and clarify that the Agricultural block one and block two are for Agricultural use, and are separate from the domestic allocation per dwelling unit.

Following discussion, it was moved by Director Frye, seconded by Director Morgan, and carried by the following roll-call vote to adopt Resolution No. 2047 as amended:

AYES: Directors Abel, Frye, Morgan, Shaikewitz, and Wilson

NOES: None

ABSENT: None

ABSTAIN: None

4. ADJOURNMENT

There being no further business to come before the MWD Board of Directors, the meeting was adjourned at 8:28 pm.
