1. CALL TO ORDER, ROLL CALL, DETERMINATION OF QUORUM

President Morgan called the meeting to order at 9:00 a.m.

There were no members of the public present who wished to address the Board on matters not on the agenda.

3. Appeals

Director Abel, on behalf of the Appeals Committee, introduced the appeals and requested that the Board consider approving the recommendations for items 3-A through 3-O on one vote. Following discussion, it was moved by Director Frye, seconded by Director Shaikewitz, and unanimously carried to approve the recommendations for items 3-A through 3-O.

Director Abel introduced this item and answered Directors’ questions. Following discussion it was moved by Director Shaikewitz, seconded by Director Morgan, and unanimously carried to deny Mr. Van Sicklen’s request for relief of charges for water that passed through his meter in October 2010.

4. Closed Session

A. Closed session item: Government Code section 54956.9(a) Conference with legal counsel -- Existing Litigation Patrick M. Nesbitt et al. v. Montecito Water District Santa Barbara Superior Court case No. 1371221

(This item was taken first in the meeting.)

The Board adjourned to closed session on the above matter at 9:02 a.m.

The Board reconvened to open session at 9:30 a.m. President Morgan reported that the Board had received a report from Counsel.

5. ADJOURNMENT

There being no further business to come before the Board, the meeting was adjourned at 10:22 a.m.
